Bharatiya Yuva Shakti Trust (BYST) provides a comprehensive and integrated platform to strategically shape regional, national and industry agendas in the field of entrepreneurship development of women and youth from underprivileged and underserved communities.

BYST is a not-for-profit organisation that primarily assists disadvantaged Indian youth in developing business ideas into viable enterprises under the guidance of a mentor. Inspired by HRH, The Prince of Wales, and founded in 1992, Bharatiya Yuva Shakti Trust is the first organisation to replicate the Prince’s Trust’s youth entrepreneurship support model globally outside the U.K. The Confederation of Indian Industry (CII) is our strategic partner.

The programmes include supporting underprivileged young entrepreneurs by supplementing financing based on the requirement assessment done by the mentor selectors, Rs. 5 lakhs being the present average and with an upper limit of Rs. 100 lakhs. They are also supported with a host of business-related activities such as training, business plan development, monitoring, mentoring, and networking. The young entrepreneurs are nurtured till they reach a level where not only are they self-sufficient, but they, in turn, make a valuable contribution to society through the creation of wealth and employment.

BYST owns, operates, and makes content and services available via the BYST Website, https://www.bystonline.org/, BYST Chatbot, BYST Grampreneur® Helpline, BYST Newsletters & Emailers, BYST Social Media Accounts (collectively “BYST Channels”) and BYST Mentor Application to the users (individually “User” and collectively “Users”) under the following Terms of Use and Privacy Policy, applicable to all BYST Channels:

Agreement to the Terms of Use

The BYST Website, Helpline, Newsletters & Emailers, Social Media Accounts and Mentor App contain content sections, features and services such as blogs, stories, impact reports and new programme announcements, events and webinars, issue and community pages, member areas and reference sources to third party websites and articles that may be available from time to time. Any person who accesses or uses BYST Channels and BYST Mentor App agrees to be bound by the terms and conditions of these Terms of Use. They stipulate conditions, disclaimers, and other provisions, some of which limit the BYST liability. Any person who does not agree to or comply with these Terms of Use should not access or use BYST Channels or BYST Mentor App. Access to BYST Channels and BYST Mentor App is granted to Users who have current and active engagements with Bharatiya Yuva Shakti Trust.

Appropriate Use

Any use of BYST Channels or BYST Mentor App by Users that would limit or constrict the availability or quality of features of BYST Channels or BYST Mentor App is prohibited. BYST reserves the exclusive right to take any actions required to enforce this principle.

Users shall not use BYST Channels or BYST Mentor App to post, submit or otherwise distribute unlawful, defamatory, abusive, obscene, or offensive materials. Furthermore, Users shall not use BYST Channels or BYST Mentor App in any way that may violate third-party rights including, but not limited to, copyrights or privacy. Neither shall Users access or attempt to access BYST Channels or BYST Mentor App using interfaces aside from the ones provided by BYST.

 

Additionally, Users may need to provide personal information as part of the registration process to access and use the features on BYST Mentor App. Information provided for registration must be accurate and up to date. BYST reserves the exclusive right to verify and deny access where data is incomplete, incorrect, inappropriate and/or missing.

Users acknowledge that BYST is not responsible nor liable for any harm resulting from: (1) use of BYST Channels or BYST Mentor App; (2) downloading information contained on BYST Channels or BYST Mentor App including, but not limited to, downloads of content posted by subscribers; (3) unauthorised disclosure of images, information or data that results from the upload, download or storage of content posted by Users; (4) the temporary or permanent inability to access or retrieve information from BYST Channels or BYST Mentor App, including, without limitation, harm caused by viruses, worms, trojan horses, or any similar contaminated or destructive computer programmes.

Disclaimer

BYST Website, BYST Chatbot, BYST Grampreneur® Helpline, BYST Newsletters & Emailers, BYST Social Media Accounts and BYST Mentor App are provided “AS IS” and “AS AVAILABLE” with no express or implied warranties of any kind including, but not limited to, any implied warranties of fitness for a particular purpose, merchantability, non-infringement, and title. BYST disclaims any and all liability for the acts, omissions and conducts of any third parties in connection with or related to the manner in which Users use BYST Channels or BYST Mentor App. Users assume total responsibility for their use of BYST Channels and BYST Mentor App and any linked sites where applicable. If this disclaimer is not enforceable under applicable law, it may be modified at BYST’s sole discretion to a form that is enforceable.

BYST does not take responsibility for any content on BYST Channels or BYST Mentor App that is incomplete, inaccurate, or not up to date. BYST expressly disclaims any and all liability to any person in respect of anything done, or omitted to be done wholly or partially, in reliance upon the contents of BYST Channels or BYST Mentor App.

Furthermore, BYST is not liable for any damage or corruption caused by viruses (or similar mechanisms such as worms, lock outs, metering, or self-destruct mechanisms) on computers or other terminal equipment in connection with visiting, using and/or downloading data of any kind from BYST Channels or BYST Mentor App. Users are personally responsible for protecting their equipment appropriately from viruses and other risks on the Internet.

BYST reserves the right, at its sole discretion, to monitor and/or remove content from BYST Channels or BYST Mentor App but disclaims the obligation thereto.

BYST Mentor App Content

With the exception of blogged content, for which all proprietary rights lie with the author of the blog, BYST reserves exclusive proprietary rights to all content on BYST Mentor App including, but not limited to, copyright, trademarks, and other intellectual property rights; this includes all text, graphics, photographs, logos and/or other items that appear on BYST Mentor App. BYST also reserves proprietary rights over the BYST Mentor App template, including its layout and structure.

BYST’s name and logo are registered trademarks of Bharatiya Yuva Shakti Trust (BYST). BYST Mentor App Users are not authorised to use the BYST logo.

 

Publications

The content of any articles published on BYST Mentor App expresses the opinion solely of the author of the respective content. The content of articles published on BYST Mentor App by authors other than BYST does not necessarily represent BYST’s endorsement of the views or content so expressed.

Links to other Websites

Links on BYST Website or BYST Mentor App may connect Users to external or third-party websites that are not related to BYST nor under its control. BYST is not responsible for the content of external or third-party websites that may be accessible or displayed through external links on BYST Website, BYST Newsletters & Emailers, BYST Social Media Accounts or BYST Mentor App. The presence of these external links does not represent BYST’s endorsement of the views or content of these third-party websites. Navigating to external websites through links on BYST Channels or BYST Mentor App is done at the sole risk of the User, and BYST expressly disclaims any liability for any content that appears on any external site.

Amendments

BYST may amend these Terms of Use at any time. Such amendments will be effective immediately upon notice being provided to the User. Notice may be provided on the BYST Website, BYST Mentor App itself, or BYST Newsletters & Emailers, and after posting of the notice, the User’s continued use of BYST Channels and BYST Mentor App will be deemed as acceptance of the modified Terms of Use.

Waiver and Severability of Terms of Use

Failure of BYST to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intention as reflected in the provision and the other provisions of these Terms of Use shall remain in full force and effect.

Applicable Law

These Terms of Use shall be governed by and interpreted in accordance with the substantive laws of India, under exclusion of any conflicts of laws principles.

Privacy Policy

This Privacy Policy stipulates the privacy practices for the BYST Channels and BYST Mentor App.

BYST is committed to complying with data protection laws and to the protection and confidentiality of the personal data of BYST Website and BYST Mentor App Users. BYST would like Users to be well informed of the gathering and use of their information through BYST Website, BYST Chatbot, BYST Helpline and BYST Mentor App. Please read this Privacy Policy carefully before accessing BYST Channels or BYST Mentor App and prior to entering your personal information. Accepting the terms of this Privacy Policy is a necessary prerequisite to registering to and accessing BYST Channels and BYST Mentor App.

The following points present the essential body of BYST’s Privacy Policy:

• general trends in the use of the BYST Channels and BYST Mentor App will be monitored;
• there will be no collection of information concerning Users unless that information is voluntarily disclosed, for example, by signing up as a User;
• there will be no selling or renting of information voluntarily disclosed to BYST nor sharing of it with any third parties; except with those other registered users of BYST Mentor App and third parties maintaining and developing BYST Mentor App;
• Users will only be contacted by BYST for purposes related to the work and/or activities of BYST;
• Users signed up for BYST Mentor App services can modify their information at any time, except for their name, email, company name, unless that information is incorrect (in which case we give the Users an opportunity to update it).

This Privacy Policy is incorporated into the BYST Mentor App Terms of Use. Any person who registers or uses BYST Mentor App acknowledges thereby that they have read and agree to be bound by the Terms and Conditions of the Terms of Use and this Privacy Policy, as they may be amended from time to time. Any User who uses or accesses CII App agrees and consents to the collection of personal information in the manner outlined in this Privacy Policy.

Use of Information

By registering for the BYST Mentor App, Users voluntarily consent to their personal data being collected by BYST and used by third parties that maintain and develop BYST Mentor App as well as by other BYST Mentor App users registered on BYST Mentor App.

BYST will ensure that third parties accessing the personal data of Users shall comply with the same data protection requirements as BYST and that the personal data will be used exclusively for the purpose set out above.

The User’s personal data will not be used for advertising or market research purposes.

BYST will analyse browsing patterns and usage trends of BYST Mentor App Users with the general information collected.

BYST periodically summarises and analyses these log files to learn how Users use content on BYST Mentor App. This information is used to improve the content, organisation, and performance of BYST Mentor App.

Security

Any information provided to BYST by Users of BYST Channels or BYST Mentor App is handled with due care and security and will not be used in ways other than as set forth in this Privacy Policy, or in any site/area-specific policies, or in ways to which Users have not explicitly consented. BYST employs a range of technologies and security measures to protect the information maintained on BYST systems from loss, misuse, unauthorised access or disclosure, alteration, or destruction. However, since the Internet is not a 100% secure environment, BYST cannot ensure nor guarantee the security of any information that the User may transmit to the BYST Channels or BYST Mentor App. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of BYST’s physical, technical, or managerial safeguards.

All BYST employees who have access to and are associated with the processing of personal data are obliged to respect the confidentiality of all such personal data.

 

 

 

User Rights

The User has the right to information relating to his/her personal data stored by BYST. The User is entitled to have any inaccuracy or error in his/her data corrected, or to have his/her data blocked or deleted. The deletion of personal data from BYST Mentor App will cancel the User’s BYST Mentor App account.

Retention of Personal Information

BYST will retain the User’s personal information for the period necessary to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

Electronic Mail

When a User sends BYST personal identifying information via e-mail (that is, in a message containing a question or a comment, or by filling out a form that e-mails BYST this information), BYST uses it to respond to User requests. BYST may forward the User’s e-mail to other employees of BYST (including affiliates or branches of BYST, also such that are located in countries that do not have legislation which provides for adequate Data Protection) who are better able to answer the User’ questions. Information collected via e-mail will be retained at the sole discretion of BYST in a directly readable form as long as it is necessary to complete BYST’s response.

BYST Mentor App may have links to other websites that are not operated or maintained by BYST and are not covered by this Privacy Policy. Users should be aware that the links on BYST Mentor App are provided only for User convenience. BYST has no control over, makes no promises or warranties of any kind with regard to, and has no responsibility or liability for, the content of any other websites or their privacy policies, their use of cookies, or the way they collect, save, store, or use information. Users should review the privacy policy of each website they visit.

Applicable Law and Venue of Jurisdiction

This Privacy Policy shall be governed by and interpreted in accordance with the substantive laws of India, under the exclusion of any conflicts of laws principles.
